Denied Entry into Canada With A DUI

If you are planning to visit Canada in the near future but have a DUI on your criminal record, be prepared to be denied entry to Canada. While a DUI is a misdemeanor crime in the United States, it is a very serious crime in Canada. If you have a DUI but intend to visit Canada, you will have to undergo a strict approval process in order to actually enter. 

Entering Canada with a record for DUI

A temporary resident permit application is one of the common ways that people who have criminal records for crimes like DUI will try to come to Canada. While a temporary resident permit will help you overcome your criminal inadmissibility and enter Canada,they are not easy to obtain.

But if your DUI occurred within the last five years, it could be one of your only options. Be prepared to provide Canadian immigration authorities with all the applicable information about yourself and your offence, including your FBI record and records for all of the places you have lived for more than six months. You must also provide character references and write a personal statement. Finally, in addition to all of the above, you must have a very valid reason for coming to Canada of a very important nature. Another option you have when denied entry to Canada is you apply for criminal rehabilitation. You may only be eligible for this option if your criminal offence, such as your DUI, is over five years old.
While criminal rehabilitation typically has a six to nine month waiting period for processing, if you are approved the inadmissibility to Canada you had will be gone. If your application is denied, you may appeal your denial but you must do so within 30 days.
